How Can You Minimize Your Resident Return Visa Processing Time?

By: stevensmith

You want RRV visa because you are a non-citizen of Australia, travelling abroad and want to return to Australia. If you are a Permanent Resident (PR), you can travel abroad and return to Australia only for a period of 5 years from the date of visa approval. RRV comes under subclasses 155 and 157

How long is Resident Return Visa Processing Time?

If you have a status of PR and file from inside Australia, the Department of Home Affairs (DHA) will aim at processing your application within ‘one’ business day. In case you apply from outside Australia, the processing time may be about ‘two’ weeks.

In case you are a former PR, the time may vary between 6 to 9 months for inside application and 9 to 12 months for outside Australia application

The resident return visa processing time is usually subjected to a number of constraints and is likely to be delayed. Therefore, hire the services of a MARA-registered competent Migration agent.

What Causes the Delay?

Every RRV application is unique because of specific individual circumstances of the applicant that may include the following:

1: Incorrect, incomplete or incoherent visa application that may arise due to inadequate knowledge and skill of the person filling up the prescribed application forms

2: Inadequate submission of prescribed supporting documents, along with the application

3: Delay in response by external agencies and compliance to any request made by the Department of Home Affairs for additional information; particularly with regard to character requirements, health requirements and national security

4: Time taken by the assessing authority for checking the supporting information provided. From the national security point of view, DHA makes meticulous assessment of the police report of the related country

5: Number of places available in the migration program, in case of Permanent Migration Visa application

6: Delay in attending a Citizenship Ceremony or for obtaining a Citizenship Certificate

Character Requirements for RRV Residence Requirement

For meeting the RRV residence requirement, you must have spent a total of at least 2 years of the last five years in Australia as a PR. If you don’t meet this requirement, you are to furnish a certificate of National Police, Australian Federal Police or Foreign Penal clearance. If you are a New Zealand citizen, residing in Australia on a Special Category under subclass 444 and are applying for your first RRV, you need to comply with the above requirements. This will reduce your resident return visa processing time

Police Certificates

In case you are required to submit an Australian Penal clearance, you can provide an Australian National Police Certificate or proof by email confirmation or receipt, evidencing that you have applied for National Police Check. This too will reduce your resident return visa processing time. The DHA accepts only the original police certificates issued by the Australian Federal Police, along with your application. It does not accept the standard disclosure certificates or national police certificates issued by the Police of your state.

In case, conducted outside Australia, you need to submit an Overseas Police Certificate. For more information, you can refer to the website; good character requirement of the Department of Home Affairs. Character requirements are laid down under Section 501 of the Migration Act 1958

Criteria for Character Test

If you want to have the minimum resident return visa processing time, you must take care of the following

  • No substantial criminal record
  • Non-conviction for escaping from immigration detention
  • Non-association with a person or group, suspected by the department, to have been involved in criminal conduct
  • Non-involvement with people, suspected of smuggling, human trafficking, crime against humanity, torture or serious crime of international nature

You can significantly reduce your resident return visa processing time if you opt for the services of MARA-registered Perth’s Migration Agent
